Terms of Use
Version 1.0.0 · Effective {{EFFECTIVE_DATE}}
Welcome to Play With Keyboard. These Terms of Use ("Terms") are a contract between you and {{COMPANY_NAME}}, {{ADDRESS}} ("we", "us"), the operator of playwithkeyboard.com and its apps, pages and features (the "Service"). Please read them. They explain what you may and may not do, who is responsible for what you record and share, and what happens if something goes wrong.
By using the Service you agree to these Terms. If you create an account you also confirm, with a checkbox, that you accept them. If you do not agree, please do not use the Service.
Other documents also apply and form part of these Terms:
- Privacy Policy – how we handle personal data
- Cookie Policy – cookies and similar technologies
- Community Rules – how to behave on the Service
- Copyright & Takedown Policy – how to report content and how we handle it
- for users in Türkiye: KVKK Aydınlatma Metni
1. In short
- You can play without an account. Recording, sharing, duels, competitions and leaderboards may require one.
- You are fully responsible for everything you record, upload, name, write or share, and for how you use the Service.
- Do not record, upload or share copyrighted music or anything else you have no right to share. The songs we teach are public domain; free play is your own responsibility.
- We may remove content and suspend or close accounts that break these Terms or the law.
- The Service is free and provided "as is". Our liability is limited as far as the law allows.
- You can delete your account and all your personal data at any time (section 15).
2. Who may use the Service
2.1 Age. You may use the Service without an account at any age with the help of a parent or guardian where needed. To create an account you must be at least 13 years old. If you are below the age of digital consent in your country (for example 16 in Germany, Ireland and the Netherlands, 15 in France, 14 in Spain and Italy, 13 in the United States, the United Kingdom and Portugal), you may only create an account if your parent or guardian has given consent through the process we provide. If we offer no such process in your region, you must wait until you reach that age.
2.2 Parents and guardians. If you allow a child to use the Service, you accept these Terms on the child's behalf and are responsible for the child's use, including anything the child records or shares.
2.3 You may not use the Service if you are barred from doing so under applicable law, or if we have previously closed your account for a serious breach.
3. The Service
3.1 Play With Keyboard lets you play virtual instruments with a computer keyboard, mouse or touch screen, learn melodies, record performances as note data, share links, duel friends, take music-knowledge quizzes and appear on leaderboards.
3.2 The Service is currently free of charge. If we introduce paid features, separate terms will apply and we will tell you before you pay anything.
3.3 We may change, add or remove features, songs, instruments or languages, and may suspend the Service for maintenance or security. We will try to give notice of major changes but cannot guarantee that the Service or any feature will always be available.
4. Your account
4.1 Give accurate information when you sign up and keep your email address current. We send codes for verification and data deletion to that address.
4.2 Keep your password secret. You are responsible for everything that happens through your account unless it was caused by our fault. Tell us at info@playwithkeyboard.com straight away if you think someone else has access.
4.3 One account per person. Accounts are personal and may not be sold, transferred or shared.
4.4 Usernames are public. Do not use your full real name if you are a child, and do not choose a name that impersonates someone, infringes a trademark, is offensive or misleading. We may change or reclaim a username that breaks these rules.
4.5 If you sign in with Google, Google's terms also apply to that sign-in.
5. Your content and your responsibility
5.1 "Your content" means anything you create or provide on the Service: recordings and note data, performances, duel and series names, display names, usernames, song requests, quiz answers, reports, messages and any other text.
5.2 You keep ownership of your content, to the extent you have rights in it.
5.3 You are solely and fully responsible for your content and for your use of the Service. This includes making sure you have every right, licence and permission needed to record and share it, and its legality in every country where it can be seen. We do not check content before it is published and we do not adopt it as our own.
5.4 Copyrighted music. Many songs, melodies, lyrics, arrangements and recordings are protected by copyright, often for 70 years or more after the author's death. You must not record, upload, title, request or share any work that is protected by copyright (or by related rights) unless you own the rights or have the rightsholder's permission. This applies even though the Service only stores note data and not audio: a melody played note by note can still be a copy of a protected work. The songs offered in our song library are selected because we believe them to be in the public domain; anything you play in free-play mode is your responsibility.
5.5 Licence to us. So that we can run the Service, you grant us a worldwide, non-exclusive, royalty-free, sub-licensable (only to our service providers) licence to host, store, copy, process, play back, display, adapt for technical purposes (for example converting formats or generating preview images) and make available your content within the Service, including on share links, duel pages, leaderboards and link previews. This licence ends when you or we delete the content, except for copies that have already been shared by others outside the Service, backups that are purged on their normal schedule (see the Privacy Policy), and content we must keep by law or to defend legal claims. We will not use your recordings in our own advertising or social-media channels without asking you first.
5.6 Public content. Content you share via a link, a duel, a competition or a leaderboard can be seen by anyone who has the link or visits that page, and may be copied or re-shared by them. Think before you share.
5.7 Indemnity. To the extent permitted by law, you will indemnify and hold harmless us, our owners, staff and service providers from any claims, damages, losses, fines and reasonable costs (including legal fees) brought by third parties or authorities that arise from your content, your breach of these Terms or the law, or your infringement of anyone's rights. We will tell you about such a claim and let you take part in the defence where appropriate. If you are a consumer, this clause applies only where you acted culpably (at least negligently).
6. Acceptable use
You must follow our Community Rules. In particular, you must not:
- break the law or infringe anyone's rights (copyright, trademark, privacy, personality rights);
- harass, threaten, bully, discriminate against or hurt anyone, or share sexual, violent, hateful or otherwise harmful content (the Service is family-friendly);
- share other people's personal data, or contact or groom minors;
- cheat: use bots, scripts, macros, auto-players, modified clients, manipulated note events or timing, multiple accounts or any other means to obtain scores, wins or rankings you did not earn;
- attack, overload, probe, scan or reverse-engineer the Service, bypass rate limits, Turnstile or other security measures, or access areas or data you are not authorised to access;
- scrape, crawl or extract data or content in bulk, or use content from the Service to train machine-learning models, without our written permission;
- send spam, advertising, chain messages or malware, or misuse invitations, notifications, reports or song requests;
- impersonate any person or organisation or pretend to be us;
- create an account after we have banned you, or help a banned user to come back.
7. Our content and brand
7.1 The Service's software, design, texts, graphics, the "Play With Keyboard" name, the Keycap Buddy mascot and logos belong to us or our licensors. You may use the Service for your personal, non-commercial enjoyment. You may share links and screenshots of your own results. You may not copy, sell or reuse our materials or brand in other ways without our permission.
7.2 Songs in our library are public-domain melodies entered by us; sounds and fonts come from public-domain (CC0), unrestricted or open-licence sources listed in our third-party notices. This does not give you rights in third-party works that you choose to play.
7.3 If you send us feedback or ideas, we may use them freely without obligation to you.
8. Duels, competitions and leaderboards
8.1 Duels, quizzes, competitions and leaderboards are for fun. There are no cash or material prizes unless we publish separate official rules for a specific event. Badges and rankings have no monetary value and cannot be exchanged.
8.2 Our servers calculate and check scores from the submitted note events and answers. We may reject, correct or remove scores, results or rankings that look automated, manipulated or implausible, and may reset leaderboards.
8.3 Someone you invite to a duel can see your username, score and recording for that duel.
9. Moderation, removal and suspension
9.1 We may — but are not obliged to — review content. We may remove or restrict any content, and warn, suspend, limit or permanently ban any account, if we reasonably believe it breaks these Terms, the Community Rules or the law, harms other users or third parties, or exposes us to legal risk, or if a valid legal notice or authority order requires it.
9.2 Where the law requires (for example under the EU Digital Services Act), we will tell you which content was affected, why, and how you can object, unless doing so is prohibited or would undermine safety or an investigation.
9.3 Repeat infringers. Accounts that receive repeated valid copyright complaints are terminated, as set out in the Copyright & Takedown Policy.
9.4 You can object to a decision by replying to our notice or writing to info@playwithkeyboard.com. A person who did not take the original decision will review it. You may also use any out-of-court dispute settlement body or court available to you.
10. Reporting content
You can report content or users with the report function or at info@playwithkeyboard.com. Copyright complaints follow the Copyright & Takedown Policy.
11. Third-party services
The Service relies on providers such as Cloudflare (hosting, database, security, email) and, if you choose it, Google sign-in. Links to other websites are provided for convenience; we are not responsible for their content or practices.
12. Disclaimer
The Service is provided "as is" and "as available", free of charge. To the extent permitted by law, we give no guarantees that it will be uninterrupted, error-free, secure, or that scores, notes, translations or musical information are accurate, and we disclaim implied warranties such as merchantability, fitness for a particular purpose and non-infringement. Your statutory rights as a consumer are not affected.
13. Limitation of liability
13.1 To the extent permitted by law, we are not liable for indirect or consequential loss, loss of data, scores, rankings, profits or goodwill, or for content or conduct of users or third parties.
13.2 To the extent permitted by law, our total liability arising from or relating to the Service in any 12-month period is limited to the greater of the amount you paid us in that period or EUR 50 (or the equivalent in your currency).
13.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for intent and gross negligence, for death or personal injury caused by negligence, for fraud, under mandatory product-liability law, or — where German law applies — for slight negligence in breach of an essential contractual obligation (an obligation whose fulfilment makes the contract possible and on which you may rely), which is limited to the typical, foreseeable damage.
14. Changes to these Terms
We may update these Terms, for example when we add features or the law changes. For material changes we will tell account holders by email or on the Service at least 30 days before they take effect, unless a change is required sooner by law or for security. The version number and effective date appear at the top. If you do not agree to the new Terms, you may delete your account before they take effect; continuing to use the Service after that date means you accept them.
15. Ending the contract and deleting your data
15.1 You can stop using the Service at any time. You can delete your account and all your personal data in your account settings, with the deletion form (username + email → 6-digit code by email → confirm), or by emailing info@playwithkeyboard.com from the address linked to your account. Details are in the Privacy Policy.
15.2 We may end these Terms or close your account under section 9, or if we discontinue the Service; in the latter case we will give reasonable notice and a chance to export your data.
15.3 Sections 5.3, 5.4, 5.7, 7, 12, 13, 16 and 17 survive termination.
16. Governing law and disputes
16.1 These Terms are governed by {{GOVERNING_LAW}}, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.
16.2 Courts of {{JURISDICTION}} have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring proceedings in your local courts; consumers in Türkiye may also apply to consumer arbitration committees (tüketici hakem heyetleri) and consumer courts within the legal limits.
16.3 Please contact us first at info@playwithkeyboard.com — most problems can be solved quickly.
17. General
- If any provision is invalid, the rest remain in force and the invalid provision is replaced by a valid one closest to its purpose.
- Failure to enforce a right is not a waiver.
- We may transfer this contract to a successor operating the Service; we will inform you, and you may delete your account if you do not agree. You may not transfer your rights without our consent.
- These Terms are available in English, Spanish, Portuguese, French, German and Turkish. Where the law of your country requires it, the version in your language prevails; otherwise the English version prevails.
